Here at ConstructionLawMonitor.com, I often get industry experts who would like my readers to hear their opinions or help spread the word on what is going on in the construction industry. Below is a write up from Derek Singleton at Software Advice regarding its Construction Estimating survey. The companies that responded to the survey represent a variety of trades and company sizes. | TEMPEST BLOG MAY 9, 2012 Estimate and Bid Ethics – Owner Estimates I have brought up estimating and bidding ethics on previous occasions. I am doing it again because it is extremely important that owners understand and know their costs before and at the bid opening. The costs in this period will influence the entire project along with the costs of it during the construction period. It would cover owners and construction managers using subcontractors to prepare the pre-construction estimates. If receiving bids, have a public opening the contractors can attend. Identifying sole sourced specifications. | | | | | | | CONSTRUCTION TECHNOLOGY JANUARY 10, 2012 Does a BIM Requirement Stop You From Bidding? Building Information Modeling (BIM) has become an industry standard on complex construction projects. As more Construction owners reap the benefits of BIM, more projects add a modeling component. Your local universities also offer training and educational programs as do the think tanks of the construction industry. Don’t let BIM stop you from bidding. | TRAIN4TRADESKILLS OCTOBER 19, 2011 Train4TradeSkills News: UK firms bid to be a part of Qatar 2022 World Cup UK Construction firm on shortlist for World Cup in Qatar. BUILDERS COUNSEL | THURSDAY, DECEMBER 29, 2011 Teams Bid For Chance to Resurrect Green Building Nightmare One of the most famous LEED Certified failures is on the mend and four contractors have submitted bids to bring it back to glory. The Statesman Journal reported this week that a total of four contractors have submitted timely bids to resurrect the Salem Courthouse Square Building. My earlier article on the RFP stated that a mandatory pre- bid meeting was scheduled for earlier this month. Interested bidders were asked to submit a Letter of Intent to Bid by last week, and four bidders did so, according to the Statesman Journal. But how about LEED for Existing Buildings? MORE >> -
CONSTRUCTION LAW MUSINGS | FRIDAY, OCTOBER 7, 2011 BIM Legal Liabilities: Not That Different Scott is an attorney with the construction law firm Watt, Tieder, Hoffar & Fitzgerald , where he represents contractors, subcontractors, owners, and engineers. When a new technology is introduced to the construction industry, contractors inevitably ask themselves one question “Great, how can this new gadget get me into trouble?” But, BIM has been around for a few years now, and the construction industry has done a good job of curtailing the fear of unanticipated legal liability. Unlike CAD, BIM also modifies the collaborative nature of a construction project. MORE >> -
TEMPEST BLOG | WEDNESDAY, FEBRUARY 15, 2012 IT USED TO BE I sound really old but there is a basic bidding knowledge that is missing in today’s construction industry! IT USED TO BE: Contractors relied upon estimators and their bid managers that would not blindly accept the goofy low subcontractor’s bid. Contractors had estimators and bid managers on staff that knew how to evaluate subcontractor bids for all disciplines. The contractors and subcontractors estimators and bid managers would not bid a project if there was not enough time to bid it right. They knew there was a problem. MORE >> -

BUILDERS COUNSEL | THURSDAY, MARCH 10, 2011 Senate Passes Washington Contractor Bidding Preference Bill Using that survey, Washington woud provide a reciprocal bidder preference (to the same amount permitted in the bidding contractor’s home state) to Washington contractors bidding for public projects. More Costly Public Works Projects: A bidding preference statute will also cost state and local governments additional money in awarding public works projects in the amount of the bidding preference percentage authorized by other states. The bill is referred to as SB 5662 and will soon move on to the House. So, this is a bill to make a bill. Earth Week Extravaganza!
