ConstructionI have heard many complaints from design teams about estimators over the years. . From “it shouldn’t cost that much” to “you killed the project”.  One of the best was when I was told that I could only offer VE items as long as they did not “interfere with the intent of the design ”.  Any VE item “interferes” with the design when you get down to it.  From choosing a more cost effective HVAC system or a more suitable glazing system, the intent is changed. It sounds to me that what the design team is really saying is “it doesn’t matter to us how much it costs”.

The change effectively makes the state’s Little Miller Act (governing bond claims against state projects) applicable to private construction projects whenever they are performed on public land. The concept being presented that sometimes a private company leases land from the state or county, and then commissions construction work.

It’s astonishing to me how so many smart people can become attorneys and allow themselves to become so consumed with inconsequential technicalities. That’s precisely what seems to have occurred  in the state of Ohio with respect to that state’s preliminary notice requirements. Specifically, Halsey sent the notice of furnishing by certified mail on May 14, 2007.

That’s A Tough Case To Prove Quickly Just this morning a letter appeared on my desk from a general contractor who claims a subcontractor’s mechanics lien is “exaggerated;” meaning it claims to be owed way more money than actually owed. See original article at Conflicting Court Decisions Highlight Complexity Of Mechanics Lien Law Last week I wrote about two court decisions released in April 2012, one out of California (Montgomery Sansome LP v Rezai) and one out of Idaho (Stonebrook Construction v. What happens in these two cases is the mechanics lien claimants do have a construction license, but they contract and file a mechanics lien in a slightly different name. ”  In Idaho, the lien and contract was as “Stonebrook Construction, LLC” but the license was in “Stonebrook Construction.”
