Contractors had estimators and bid managers on staff that knew how to evaluate subcontractor bids for all disciplines. The estimators for contractors and subcontractors knew their obligations by reading the plans and specifications and management listened to them. In Richard A. Arena Jr d/b/a Water-Tite Roofing v. Graybar Electric Company, Inc. et al, the 5th Circuit held that a federal court does not have jurisdiction over a construction dispute on a federal project unless a Miller Act Bond was actually present. Without a bond, the 5th Circuit reasoned, there is no federal question jurisdiction. | | | | | | | | | -

If you’re unpaid for labor or materials furnished to a state or federal construction project, you’re entitled to file a claim against the payment bond. This works exactly like a traditional mechanic’s lien claim, except that instead of filing your claim against the property itself, you’re filing a claim against the payment bond, which stands in place of the property.
