And based on my experience in mechanic lien laws across the United States, they have the greatest level of protection under these statutes. When a state requires preliminary notices, they very frequently do not require them from pure laborers. And in some states, like Oregon, a laborer’s lien gets super-priority over other liens and encumbrances (like bank mortgages). CONSTRUCTION LIEN BLOG | FRIDAY, AUGUST 12, 2011 Even Late Preliminary Notices May Be Worth Sending… Whenever a state requires preliminary notices, those notices must be sent within a certain time frame (see our color coded map of preliminary notice requirements throughout the United States ). Normally, the period for sending notice is calculated from the first day your company furnishes labor or materials to the project, with some states requiring notice within just 8 days (Oregon) and others allowing as long as 60 days (Washington). Likewise, in California, notice is required within 20 days of first furnishing labor or material. MORE >> -

Here is a few things that are happening to help PACE stage a comeback, and a glimpse at how this might affect the PACE Programs: 1) California is Fighting It : First, Sonoma County and the California Attorney General have both separately filed suit against the FHFA claiming that the determination is wrong, or that FHFA lacks jurisdiction to make the determination on behalf of states and counties. 3) Re-Thinking PACE: States may be ready to re-think the way they structure these PACE programs, and provide some protections for mortgage companies.
