BUILDERS COUNSEL | THURSDAY, APRIL 7, 2011 USGBC Faces Deadline to Answer, Files Motion to Dismiss / The. Thanks to some quick reflexes from New York attorney, Stephen Del Percio, I was able to get a quick read on the USGBC’s motion, today. or for any of the new co-plaintiffs added to the FAC. Of course, it will be interesting to see how this New York Federal Court will evaluate USGBC marketing materials put out into the public view. The USGBC has filed a FRCP 12(b)(1) & (6) motion, as expected, challenging subject matter jurisdiction (standing) and the sufficiency of the claims themselves.
